General Provisions

These terms and conditions are intended for purchases in the online shop at www.shaveholder.cz. They also set out the business relationship between the purchasing customer (buyer) and the seller, who is also the operator of the online shop. The terms and conditions, governed by the law of the Czech Republic, determine the rights and obligations of the seller and the buyer arising through the online shop in the form of an e-shop.

The seller and operator of the online shop www.shaveholder.cz is a person René Pajurek.

The seller declares that all items sold in this online shop are his own products.

The buyer is a consumer who buys the products for his own use.

The buyer may also be a businessman who buys the products as goods for resale. If it is a buyer who is a contractual partner of the seller and has a valid purchase contract, then the written purchase contract and its terms apply to this relationship. The entrepreneur can use the e-shop to place an order. For bulk orders, the seller recommends the use of an enquiry form or, better, email correspondence.

Purchase contract

The purchase contract is created on the e-shop by the complete and truthful completion of the order by the buyer, who confirms that he has read the terms and conditions of the online store and that he agrees to them.

The Seller shall promptly confirm to the Buyer the delivery and acceptance of his order. This confirmation will be sent to the e-mail address indicated in the order, thus concluding the purchase contract.

In accordance with the law, it is possible to withdraw from such a contract of sale without giving any reason within 14 days from the date on which the buyer took over the product from the seller or from the carrier. The buyer must send the withdrawal in writing to the seller’s contact email or address. In this case, the buyer is obliged to return the product to the seller (in person, by post without COD, via carrier without charge) in unused condition without damage. If the product is returned damaged, the seller is entitled not to agree to withdraw from the contract and the buyer is not entitled to a refund.

If the product is returned in good condition, the Seller shall agree to withdraw from the contract and shall refund the value of the product purchased (excluding shipping or cash on delivery charges) to the account of the Buyer specified by the Buyer in the withdrawal request within 15 days.

The Buyer shall create his/her order through the e-shop, which is part of the Seller’s website. He is obliged to provide complete and truthful information in the order form. The order is automatically sent to the Seller and a confirmation is automatically generated that it has been received. The confirmation is sent to the email address the buyer provided in the order. The seller takes the received order as binding.

If the Seller accepts the order and finds that the product can no longer be produced, he has the right to cancel the order, in whole or in part, or to agree with the Buyer on a different performance. If they agree to cancel the order in full and the buyer has already paid the purchase price, the seller is obliged to return the money to the buyer immediately by transferring it to the bank account specified by the buyer.

The range and prices of the products are valid for the time they are listed in the collection on the e-shop, the seller reserves the right to mark those products that are not currently in stock by notifying the buyer of this fact or to place for the period on the e-shop only those products that will be available in the near future.

Payment of the purchase price and delivery (shipping, transport)

On the Seller’s e-shop, the final selling prices including VAT are listed. To these are added charges for shipping (postage), or for other forms of transport to the Buyer’s address specified in the order as the address for delivery (including dispatch points). The prices for shipping or postage indicated in the e-shop are valid for the Czech Republic (for Zásilkovna it is possible to order also to Slovakia with the appropriate price for delivery). Prices are detailed on the seller’s website on the page Shipping and payment. Payment for shipping or sending elsewhere abroad will be negotiated individually, the seller will inform the buyer about it before handing the product to the carrier or post office. Also in cases of bulk orders, the price for shipping or delivery will be negotiated individually. The shipping price already includes the packaging costs, i.e. the cost of suitable packaging of the product. The Seller may allow the Buyer to waive the shipping fee completely for purchases above the agreed financial amount. He will be informed of this in the e-shop when creating his order.

The Buyer shall choose the method of payment in his order on the e-shop. Cashless payment by card via a verified payment gateway is possible. This payment is free of charge. Information about the successful payment is included in the order confirmation, which is sent to the buyer immediately after the order is accepted. The paid order is accepted and its processing will be initiated within the time specified on the e-shop (delivery or dispatch time).

The buyer can choose to pay on delivery, where the purchase price including the fee for payment on delivery is paid by the buyer directly to the delivery agent or upon receipt of the shipment at the selected dispatch point. Payment on delivery is charged (in addition to the shipping price) at the rate indicated in the e-shop. Cash on delivery charges are also clearly listed on the website, on the Shipping and Payment page.

Currently, the prices for shipping (postage) and cash on delivery are set according to the price list of the Czech Post a.s. and Zásilkovna s.r.o. and PPL CZ s.r.o. The Seller reserves the right to change these prices in case of price adjustments by these providers.

For orders over 2000 CZK (total price for the ordered goods including VAT and excluding taxes), shipping, postage and cash on delivery are free of charge.

If the buyer does not collect the shipment or delivery is not possible and the shipment is returned to the seller, the seller will be forced to require the buyer to pay the postage for reshipment.

The Buyer must properly inspect and accept the shipment upon receipt. If the parcel is damaged, the buyer has the right not to accept it and to claim it immediately from the Czech Post or the Post Office or PPL CZ. If this situation arises, the Seller recommends the Buyer to inform the Buyer and tell what the damage was.

The shipment includes a leaflet with information about the correct use and maintenance of the products. The shipment includes a tax receipt for the ordered goods, containing the VAT calculation and the delivery price.

Delivery times

The products will be sent to the buyer within a maximum of 15 working days from receipt of the order.

Delivery times for products that are not normally in stock (on order) or for products arranged individually (other designs, other sizes, adjustments, etc.) will be agreed individually, the agreed date will be confirmed by the seller to the buyer in writing in an e-mail correspondence or communicated by telephone.

Rights from defective performance and quality guarantee, handling of complaints

The rights and obligations of the Seller and the Buyer are governed by the valid and generally binding legislation of the Czech Republic – the Civil Code (No. 89/2012 Coll.), section Purchase, in particular the provisions:

By the purchase contract, the seller undertakes to hand over to the buyer the thing which is the subject of the purchase and to allow him to acquire the ownership right to it, and the buyer undertakes to take over the thing and to pay the seller the purchase price.

The Seller shall hand over the object of purchase to the Buyer in the agreed quantity, quality and design. In the case of the products of the entrepreneur René Pajurk, the execution means the type, pattern and size indicated in the photograph and in the description of the product on the Seller’s website (e-shop).

The rights of defective performance are generally as follows – the item is defective if it does not have the characteristics according to the agreed quantity, quality and design. The Seller is liable for the fact that the item has no defects upon receipt (except for damage caused by the carrier or delivery person). The seller is also liable for the fact that the item is fit for the purpose for which it is stated.

The rights of defective performance specifically for the products of the entrepreneur René Pajurk are as follows – the seller states that his products are suitable for the storage of dry baked goods and he has a certificate from the SZU for this purpose. The conditions for such preservation are stated by the seller on its website and are indicated on the package leaflet which the buyer receives together with the product. The Seller shall not be liable for any damage or problems that may arise from storing other foods or materials or other items, or from improper storage of baked goods other than as specified in the instructions. The seller states on its packaging the mould-resistant nature of the inner fabric and the extended freshness of the pastry compared to a cloth or plastic bag, but does not state that the pastry can never become mouldy or hard in the packaging. Pastry is a perishable food and contains starch, so moulding cannot be completely prevented (except by freezing). The rate of moulding is also determined by the quality of the bread itself and the hygiene of its storage at the manufacturer’s and trader’s premises. The rate of hardening is also determined by the quality of the pastry and previous storage.

In the case of products for bulk shopping, these are intended for dry and loose food shopping only. Only products marked in the e-shop as suitable for food storage are intended for home storage and preservation of bulk and dry foods. For products for unpackaged shopping, no package leaflet accompanies the product. Maintenance information for the product is provided on the textile label.

The warranty period for René Pajurk’s products is 24 months from delivery or receipt. The warranty does not cover defects caused during shipment or transport to the buyer. The warranty does not cover defects caused by the buyer himself or caused by improper use and improper maintenance of the product. The Buyer must notify the Seller of any defect found without delay by contacting the contacts listed on the product or the Company’s website.

The warranty period may not coincide with the life of the product. Prolonged or excessive wear and tear of a textile product, and in particular if caused by improper maintenance or improper use, is not considered a defect and therefore not a legitimate cause for complaint. Improper maintenance (washing, ironing, drying, etc.) as well as excessive wear and tear caused, for example, by carrying or hanging by the strings of large-sized packages after filling with heavy baked goods (see instructions on the package leaflet) may shorten the life of the product.

Complaints must be made in writing by the purchaser and must contain all the information necessary for the complaint to be processed. The Seller must process the complaint within 30 calendar days of receipt and communicate with the Buyer making the complaint. Furthermore, the Seller must comply with the Consumer Protection Act in the complaint procedure.

Protection of personal data under GDPR

All information arising from the GDPR regulation is listed in the bottom bar of the website under the link GDPR Information and can be consulted before filling in the enquiry form or order. The buyer agrees to these terms and conditions by checking the consent box at the bottom of the online order form. By submitting an order from the online order form, the Buyer confirms that he/she has read the Privacy Policy and accepts it in its entirety. If the buyer has a request for information to be completed or for a change in the handling of his/her personal data, he/she has the option of sending this request to the seller’s email, who will complete the information or make the change within the framework of the GDPR regulation.
